EU
Commission Regulation (EU) 2024/1987 of 30 July 2024 amending Regulation (EU) 2023/915 concerning maximum levels of Nickel in certain foods.
In 2015, the European Food Safety Authority adopted its Scientific Opinion on the risks to public health associated with the presence of Nickel in food and drinking-water. This Opinion identified reproductive and developmental toxicity as an important risk factor for the risk profile of long-term oral exposure to Nickel.
The Authority concluded that Nickel can cause both chronic and acute effects. Therefore, maximum Nickel levels in foods should be established to ensure a high level of protection for human health. Regulation (EU) 2023/915 should therefore be amended accordingly.
On 31 July 2024, the EU published Commission Regulation (EU) 2024/1987, establishing maximum nickel limits for foodstuffs. The affected product categories, subcategories and corresponding maximum levels are set out in Section 3 of Annex I to Regulation (EU) 2023/915. The affected product categories include:
- Plant nuts
- Root and tuberous vegetables
- Fruit vegetables
- Cruciferous vegetables
- Leafy vegetables
- Legumes
- Stalk vegetables
- Seaweeds
- Beans
- Oil seeds
- Cereal products
- Cocoa and chocolate products
- Infant formulas, follow-on formulas, foods for special medical purposes for infants and young children, and infant formulas
- Cereal-based foods for infants and young children
- Foods for infants and young children that do not include specific products
- Fruit juices, fruit nectars, and vegetable juices that include fruit
The specified maximum nickel levels for these products will take effect on July 1, 2025, except for cereals, which will apply on July 1, 2026. Foods that were legally placed on the market before the effective date may continue to be sold until the expiry date or the corresponding minimum expiry date.
